Continuation Recommendations: Identify Coverage Gaps and Strengthen Your Portfolio

Discover how ArcPrime identifies claim coverage gaps and recommends continuation filing strategies for your portfolio

Written by Jonathan Liu

ArcPrime's continuation recommendations analyze your patent claims to identify unclaimed subject matter, suggest broadened claims, and recommend targeted claims based on competitor product coverage. Use them to make informed decisions about where to file continuations.

Key Capabilities

  • Unclaimed subject matter β€” ArcPrime analyzes your patent specification and identifies concepts disclosed but not currently claimed. It suggests new claims to cover these gaps.

  • Broadened claims β€” ArcPrime recommends ways to broaden existing claims by removing or generalizing limiting elements, expanding your coverage without departing from the specification.

  • Targeted claims β€” When deep research results are available, ArcPrime recommends claims specifically designed to improve coverage against identified competitor products.

  • Family claims comparison β€” A side-by-side analysis of claims across patent family members, highlighting which concepts each member covers, elements that drive breadth, and elements that narrow scope.

  • Custom instructions β€” Provide specific guidance to focus the analysis on particular aspects of the technology, competitor landscape, or claim strategy.

How It Works

Open a patent and select the Continuation Recommendation tab. If no recommendation exists, click Run Continuation Recommendation to start the analysis. You can optionally add custom instructions before running.

The analysis runs in the background. Once complete, results appear across three tabs:

  • Unclaimed Subject Matter β€” Concepts from the specification that are not covered by current claims. Each concept includes a recommended claim and reasoning.

  • Broadened Claim β€” Variations of existing claims with reduced limitations. Each broadened claim includes reasoning for why the broader scope may be valuable.

  • Targeted Claim β€” Claims tailored to specific competitor products identified through deep research. This tab is available when deep research has been run on the patent.

Getting Started

To analyze your patent's coverage gaps, see How to Analyze Coverage Gaps. To compare claims across your patent family, read How to Compare Family Claims. To learn how deep research feeds into targeted claims, see How Deep Research Informs Continuation Decisions.

Tip: Run continuation recommendations after receiving a notice of allowance. This is the ideal time to evaluate whether a continuation filing would strengthen your portfolio coverage.
