USPTO Deadline Extensions: Automatic Tracking on Tasks

See how ArcPrime moves USPTO office action and appeal deadlines forward while extensions remain, and closes tasks when Patent Center shows the response.

Written by Jonathan Liu

ArcPrime tracks the USPTO response deadlines behind your prosecution tasks and keeps each due date in step with the file history. While extensions remain, a passed due date moves forward one month at a time. The task closes on its own when Patent Center shows the response.

Key Capabilities

  • Extension roll-forward — A passed due date moves to the next monthly extension date, up to the USPTO maximum.

  • Extension tag — An ext tag counts the extensions in use: yellow while more remain, red on the last one, grey once closed.

  • Automatic closing — A qualifying response or a later USPTO action marks the task Completed, and a USPTO notice of abandonment marks it Cancelled.

  • Filing awareness — A Filed, RCE, no submission or Abandonment filed tag flags a filing that does not yet discharge the deadline.

Examiner's Answer

None

An Advisory Action or Improper RCE notice does not start a new period. Its task keeps the final rejection's date and extension count, and so does a non-compliant amendment filed after final. If ArcPrime cannot tell which response period a notice belongs to, it creates the task as Blocked with no due date.

How Tasks Change on Their Own

ArcPrime reviews a patent's deadlines when new USPTO documents arrive, and checks every open deadline again once a day. The dashboard also applies any available extension each time it loads, so a date that can still be extended does not show as past due.

For an office action, an amendment, a notice of appeal, a later Office action or an allowance marks the task Completed. For a final rejection, a response after final only moves the task to In Progress. The task closes on an RCE, a notice of appeal, an Advisory Action, a new action or an allowance.

An RCE closes a task only together with its submission. A filing receipt USPTO has not yet recorded as a response, an RCE without a submission, or an express abandonment USPTO has not yet confirmed with a notice of abandonment moves the task to In Progress. The clock keeps running, so the task can still go past due.

An Advisory Action task also closes when you file an appeal brief or when a later Advisory Action arrives. A Review Appeal Brief task closes when the appeal brief is filed, even on the same day as the notice of appeal.

A fee payment receipt alone does not move a non-final office action or non-compliant amendment task to In Progress. Those replies normally carry no fee.

ArcPrime changes only tasks that are open, in progress, or blocked. A task you completed or cancelled yourself stays as you left it.

Reading the Deadline Popover

When a deadline can be extended or has a pending filing, its due date is a button. Click it to open the Deadline popover. Its first line reads, for example, "Due 3/14/2027 · extension 1 of 3 · final 5/14/2027 · Extended".

Further lines can follow:

  • Projected using available extensions; filing and payment are not confirmed. — The date includes an extension not yet on record.

  • Receipt, RCE filed or Express abandonment filed lines — Explain a Filed, RCE, no submission or Abandonment filed tag.

  • Closed by — Names the document and date that closed the deadline. A Superseded tag means USPTO withdrew that document and re-issued the filing.

  • Extension details unavailable — ArcPrime does not know the extension limit for this deadline.

The extension and filing tags also appear on the Next Task card of the patent detail page. To see the original due date and remaining extensions as columns, turn on Default due date and Extensions possible (see how to customize your dashboard).

Note: ArcPrime does not file extension requests or pay extension fees. A rolled-forward date assumes you will. Check each extended deadline against the file history and your docket before relying on it.
